Annie Lova Photography Contract
DEPOSIT:
In order to secure your shoot, a deposit fee is required. (See Investment to find your deposit amount need to book your date/time). This is not an extra fee, but is deducted from the full sitting fee. You can pay deposit fee by Paypal to lor.annie@rocketmail.com or Facebook pay “Annie Lova”.
PAYMENT ARRANGEMENT:
The Client shall make a deposit to retain the Photographer to perform the services specified herein. At such time as this order is completed, the deposit shall be applied to reduce the total cost and Client shall pay the balance due. Balance shall be paid in full during or before the session for the service to be provided. Annie Lova Photography accepts cash and online payment.
SESSION IMAGES:
Within 2-4 days, a quick sneak peek of your photos will be announce on Annie Lova Photography [Facebok Business Page]. Your proofing gallery (unedit) will take within 7-10 business day. Sometimes earlier. Photographer retains the right to edit the photographs as she sees fit based on experience and expertise and omit any image(s) that do not meet her standards. Clients will have an online proofing gallery to make their selection. Once selections are made the turn around takes about 2 weeks. Annie will provide any additional payment amount need if additional images are purchased.
ADDITIONAL IMAGES :
Any additional images client would like to add on with their order would be $15.00 per image. Your payment is required before images can be release to you.
CANCELLATION/POSTPONEMENT:
Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the deposits paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours (48) notice of postponements or cancellations is appreciated. If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
COOPERATION/NO SHOWS:
Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders Photographer’s ability to obtain quality shots. If Client and/or key individuals fail to appear to a scheduled portrait session, the deposit is non-refundable.
COPYRIGHT:
The Photographer retains the entire copyright at all times throughout the world for the photographs taken during the specified session. Where a digital file of photographs has been provided to the Client as a part of their personal collection, these photographs may be printed and displayed at home and on-line, for personal but not commercial use.
The Photographer retains the right in all cases to use the photographs obtained under this agreement in any manner at any time in any part of the world for the purpose of advertising or otherwise and maintains ownership of the original digital file.
FACEBOOK SNEAK PEEK/ADVERTISING:
Photographer may show sneak peek of photos from the session on Annie Lova Photography page. Photographer may use photos to advertise for its business purposes only. If you do not want your photos shown please communicate directly with the photographer.
LIMITATION OF LIABILITY:
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
RETOUCHING, CONVERSIONS AND DIGITAL FILES:
Standard retouching is included in the session fee. Standard retouching includes light blemish, bruises and scratch removal. Lessing of scars or mild acne. Skin may be smoothed to look soft. Not included is complex retouching: hair color changes or adjustments, extreme scarring, laugh lines, nail color/filing, and body-shaping. Please inquire for costs on complex retouching. Photographer has the right to refuse any requested edits to the images.
NEWBORN SESSIONS:
Newborn sessions are typically held within 1-4 weeks of life. If baby required a NICU stay we will complete the session once the baby arrives home. You will need to book your session within 2 days of arriving home from the hospital if not before. If you fail to contact us to schedule your session your deposit is forfeited or is applied toward a future session. There are no refunds on the deposit if you change your mind after the baby arrives since your date has been reserved and held preventing other clients from booking. Refunds will be given in extreme cases and are at the discretion of Annie Lova Photography.
